VALKYRIE Warranty Policy

I. Introductory provisions

This Valkyrie warranty policy (»Warranty policy«) is prepared by HW GAMING SOLUTION LTD, October 28, 261,VIEW POINT TOWER, 3035, Limassol, Cyprus, registered with the Business Register with Registration Nr.: HE 436806, VAT Nr.:

CY 104368060 ("we" or "us").

The purpose of this Warranty policy is to inform the customer about the warranty, warranty procedure and other requirements in connection with Valkyrie products.

II. Definitions

The following definitions shall have the meaning as described in this Warranty policy:

  • The Valkyrie products: shall mean all products that are the part of Valkyrie portfolio of products which is available at www.my-valkyrie.com.

  • The warranty: shall mean the warranty given by us.

  • The warranty period: shall mean the length of warranty that shall begin on the date of purchase.

  • The customer or you: shall mean the consumer, who is natural person who purchases Valkyrie product/s for purposes which are outside his trade, business, craft or profession.

  • The retailer: shall mean the official reseller of the Valkyrie products in the certain territory.

  • The territory: shall mean the country where the Valkyrie product/s are purchased.

III. Warranty period

All Valkyrie products usually have 5 year warranty from the date of purchase. But the warranty period of each Valkyrie product may vary. For details, please refer to our website available at: www.my-valkyrie.com, user manual, product packaging or consult the retailer. In case of inconsistent warranty periods, the longer warranty period shall prevail. If no proof of purchase can be presented upon request, we cannot be held responsible for warranty.

This warranty gives you specific legal rights. You may also have other rights granted under local law. These rights may vary depending of the territory where you purchased the Valkyrie product.

IV. Warranty procedure

In order to request a warranty repair or refund, please apply for a valid warranty at your point of purchase with retailer, within a specified time after purchase. The time period may vary depending on the sales platform and the Valkyrie products you have purchased.

Please confirm the after-sales policy with the retailer whom you purchased the Valkyrie product from.

Any applications for warranty that cannot be submitted through the original point

OT purchase, should be submitted directly to us. We will check where the custpurchased the Valkyrie product and we will contact the retailer. The retailer shall resolve the warranty problem with the customer.

The retailer can always contact us with a question if it is not clear whether to approve or reject the customer with warranty that covers Valkyrie product.

To apply for warranty through us, you will need to submit a valid proof of purchase (receipt, or invoice), Valkyrie product image, product serial number image, and a detailed description of the problem. By submitting all required documents, we will open RMA procedure.

We do not provide customers with any form of refund. Valkyrie products returned through retailers must comply with the respective return and refund policies of the retailer.

Returning of your Valkyrie product

If you need to return the Valkyrie product for replacement or repair, be sure to obtain an RMA confirmation or a written confirmation email from our team. If the Valkyrie product is returned without confirmation, our retailer will reject the product and it will be returned to the sender. The shipping cost will be covered by the sender.

Your RMA confirmation will specify the specific return address you must use when sending the RMA package back to the retailer. This will be your standard return location and the change of the return location is subject to prior approval from us or retailer. Packages received at unauthorized locations will be rejected and returned to the sender, and the shipping costs will be covered by the sender.

Please use packing material that provides adequate safety protection for the Valkyrie product: all packages that are externally damaged will be rejected and returned to the sender. The shipping cost will be covered by the sender.

Our retailer will perform a visual inspection prior to the receipt of the parcel to ensure that there is no visible damage during transit that may affect the return of the product. We or the retailer are not liable for any damages during transit to the RMA receiving location.

Please choose a return shipping method that provides tracking information; our retailer or us are not responsible for lost or misdirected packages. In order to avoid problems when receiving the Valkyrie product, please be sure to inform retailer of the tracking information of the package in advance, and attach a copy of your RMA confirmation email to the package. Packages that arrive without prior notification of the tracking information will be rejected and returned to the sender.

After inspection, the receipt of the product will be confirmed and processing of the returned item will begin. The specific processing time will vary depending on the product and the service that has been requested. The corresponding retailer will provide updated information to the customer after the product has been received.

In order to provide the best service possible, we will continue to update this warranty service policy without notice.

V. Valkyrie product warranty

We do not guarantee that the Valkyrie product will meet your specific requirements and you are responsible for determining whether this Valkyrie product is suitable for your application.

We guarantee that the Valkyrie product is free from defects in materials and workmanship for a specified period of time from the date of purchase, when given normal, proper and intended usage.

The warranty policy does not apply to non-Valkyrie branded products, even if they are packaged or sold with Valkyrie products.

The Valkyrie products you purchase will be used normally in the expected working environment during the warranty period according to the technical parameters specified in the data sheet.

Our warranty is not an unconditional guarantee. Any replaced parts become the property of us or retailer. The warranty does not apply to the software component of a Valkyrie product or a Valkyrie product which has been damaged due to accident, misuse, abuse, improper installation, usage not in accordance with product specifications and instructions, natural or personal disaster, unauthorized alterations, repairs or modifications.

The warranty does not cover any events such as below:

  • any damages that are not related to manufacturing defects.

  • any unsuitable environment or use of the Valkyrie product in our opinion.

  • any Valkyrie product which has been modified without official permission from us, or on which the serial number or warranty sticker has been defaced, modified, or removed.

The warranty does not cover any damage, deterioration or malfunction resulting from:

  • accident, abuse, misuse, neglect, fire, water, lightning, or other acts of nature, commercial or industrial use, unauthorized product modification or failure to follow instructions included with the product.

  • third party products using Valkyrie product will not be covered by warranty.

  • repair or attempted repair by anyone not authorized by us.

  • any shipment damages (claims must be made with the carrier).

  • unauthorized repairs to a Valkyrie product will void the warranty offered by us. We reserve the right to refuse to service any Valkyrie product which has been altered, modified or repaired by non-retailer personnel.

  • Valkyrie product malfunction or damage resulting from liquids or moisture. all accessories that malfunction due to physical damage such as: USB cables, extension cables, adapter cables, adapters, power cords, screws, retention brackets, ear cups, and all other similar accessories.

  • wear and tear, due to the aging of materials.

For any Valkyrie product that does not comply with the published specifications, the identification and remedial measures of liability can only be made based on the judgment of us; the repair or replacement cost of the product is borne by us. A prerequisite for this warranty is that the product must be returned to the original place of purchase or to another location designated by us with the original proof of purchase. You may be required to pay shipping and handling charges, as well as any applicable duties, taxes or other charges. We will determine whether to repair the product or provide a new product based on relevant technical standards.

If a Valkyrie product proves to be defective in material or workmanship during the warranty period, we will, at our sole option, repair or replace the Valkyrie product with same Valkyrie product or similar Valkyrie product. The replacement Valkyrie product assumes the remaining warranty of the original Valkyrie product or for a period of 30 days, whichever is longer, or by the local legal warranty.

Who is covered under warranty:

The warranty is non-transferable. The original customer purchasing the Valkyrie product is covered under the warranty.

VI. Damaged hardware of customer due to usage of Valkyrie product

Damaged parts on customer's hardware caused by Valkyrie product:

In case that any parts of the customer's hardware are damaged caused by the leakage of Valkyrie product, the Valkyrie shall during warranty period assume its liability due to damage caused by Valkyrie product, under conditions as defined below:.

The customer shall for any damage occurring during warranty period follow the following process:

  • the customer shall notify the seller about the damage and attach photos or other document to justify the damage. Ask the seller to collect the damaged parts, the seller shall test damaged hardware or hardware parts to check if the damage was caused by the Valkyrie product. The reseller shall in mutual cooperation with us decide whether the damage was caused by Valkyrie product or not. In case that the Valkyrie product caused the damages on customer's hardware, we/seller shall compensate the customer for damages, or we/seller shall offer and send the customer new hardware as the damaged one was, or we/reseller will repair the damaged hardware, the choice is up to us/seller.

  • in case of compensation, the Valkyrie's compensation offer for the damaged hardware of the customer shall be in the used goods current market value of the customer's damaged hardware that can be found on local market platform by the country of the customer's habitual residence (e.g. eBay, Amazon), and under conditions as follows below.

If the same damaged customer's hardware cannot be found on the local market platform, the compensation for the damaged customer's hardware shall be calculate as follows:

  • Up to 6 months after customer's purchase of its hardware (date of invoice indicates purchase date), the full purchase price invoiced for the hardware is refunded as compensation for damages on customers hardware.

  • 6-12 months after the customer's purchase date of the hardware (date of invoice indicates purchase date), the Valkyrie shall refund 90% of the hardware value indicated on customer's invoice as compensation for damages on hardware, if the Valkyrie warranty period still applies:

  • 12 months up to 4 years after the customer's purchase date of the hardware (date of invoice indicates purchase date), the Valkyrie shall refund 80% of the hardware value indicated on customer's invoice as compensation for damages on hardware, if the Valkyrie warranty period still applies;

  • 4-5 years after the customer's purchase date of the hardware (date of invoice indicates purchase date), the Valkyrie shall refund 50% of the hardware value indicated on customer's invoice as compensation for damages on hardware, if the Valkyrie warranty period still applies:

  • or customer's damaged hardware that was purchased over 5 years ago (date of invoice indicates purchase date), the Valkyrie does not give any refund as compensation to the customer, regardless of whether Valykrie warranty period for Valkyrie product still applies (NO REFUND).

In case that the seller does not respond on the customer's request in connection with damaged customer's hardware caused by the Valkyrie product, the customer can always contact us with the customer's request.

VII. Limitations of warranties

There are no other oral or written warranties, expressed or implied, including but not limited to those of merchantability or fitness for a particular purpose, except for the warranty that is covered in this Warranty policy. The duration of implied warranties is limited to the warranty length specified in Paragraph III.

VIII. Disclaimer

Our sole obligation and liability under this warranty is limited to the repair or replacement of a defective Valkyrie product at our option. We shall not, in any event, be liable to the customer or any third party for any incidental or consequential damage, (including, but not limited to, damages resulting from interruption of service and loss of business), or liability in tort relating to this Valkyrie product or resulting from its use or possession.

IX. Important information for warranty

In territory of European Union (EU):

Within the first 2 years after purchase, please return your Valkyrie product to your dealer or retailer for a replacement. If the Valkyrie product is still within warranty and you can no longer return it to your dealer or retailer, please contact us for assistance and instructions. We will not accept returns without prior approval and an RMA confirmation.

When returning Valkyrie product, please be sure to enclose a clear description of the problem and your proof of purchase with the defective Valkyrie product and return it as instructed by us or retailer. Be sure to package the Valkyrie product securely (preferably in its original packaging). We or retailer will not be responsible for damage due to shipping. During the warranty period, your Valkyrie product will be repaired or replaced without charge, excluding shipping and handling.
